Pataki Signs Sweeping Gun Control Law

UPI
Thursday, Aug. 10, 2000
GARDEN CITY, N.Y. - Gov. George Pataki signed into law sweeping gun
legislation Wednesday making New York the first state in the country to
close the loophole in the federal Brady Act that allows guns to be sold
without background checks at gun shows.
"New York has taken a courageous stand," Democratic Rep. Carolyn McCarthy
said at the bill signing. McCarthy's husband was killed and her son injured
when a man went on a shooting rampage on the Long Island Rail Road in 1992.
Since then, McCarthy ran for the U.S. Congress and has been a strong
advocate for gun control.

The Long Island congresswoman said she plans to take Pataki's bill to
Congress and say, "Look what can be done if we work together. The time has
come for gun-safety legislation on a national level and New York has shown
the way."

Pataki's proposal calls for ballistic fingerprinting, trigger locks, banning
the sale of assault weapons, raising the age of handgun ownership from 18 to
21 and instant background checks to be made of gun buyers at flea markets
and gun shows.

New York is the first state in the country to deal with the Brady Law
loophole that allows guns to be sold at gun shows and flea markets without
background checks unless they are sold by a federally licensed dealer.
Violators could be fined $10,000.

The ballistic fingerprinting proposal is the most controversial of the
proposals and requires gun dealers and manufacturers to send the state a
test bullet and shell casing from every handgun sold in the state. The
ballistic fingerprinting would create a DNA-type database for each handgun
sold. Gun proponents said the ballistic database will be the first step in
national gun registration and that a criminal can alter the gun barrel,
changing the weapon's fingerprint.

Pataki called the gun legislation "common sense" and something that the rest
of the country should look at, and he hopes other states use it as a model.

The law bans all assault weapons listed under a 1994 federal law and makes
it a felony to possess or sell any banned assault weapon.
